Terms of Service

1. Acceptance of Terms

By accessing or using RoomX AI (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and RoomX AI. We reserve the right to update these Terms at any time. Your continued use after changes constitutes acceptance of the updated Terms.

2. Account Registration and Eligibility

2.1 Account Creation

To use RoomX AI, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activity under your account

2.2 Account Suspension

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse the Service.

3. Credit Plans and Billing

3.1 Free Plan

The Free Plan includes 2 staging images per month with a watermark. It does not include videos and does not require a payment card.

3.2 Monthly Subscriptions

• Lite: $12.90 per month for 200 credits
• Pro: $29.90 per month for 600 credits
• Ultimate: $49.90 per month for 1,400 credits

Monthly subscriptions renew every month until you cancel renewal. Credits from a monthly subscription expire at the end of each billing period.

3.3 Yearly Subscriptions

• Lite: $89.90 per year for 1,800 credits
• Pro: $179.90 per year for 5,400 credits
• Ultimate: $299.90 per year for 13,200 credits

Yearly subscriptions are billed in full once per year. All credits for the year are issued at once after payment is confirmed. Yearly credits do not expire.

3.4 One-Time Credit Packs

• Starter Pack: $24.99 one-time for 300 credits
• Creator Pack: $54.99 one-time for 800 credits
• Studio Pack: $119.99 one-time for 2,000 credits

One-time packs do not renew. Credits from a one-time pack are valid for one month.

3.5 Billing, Renewals, and Cancellation

• Credits are added to your account only after payment is confirmed
• Subscriptions renew automatically at the end of each billing period until you cancel renewal
• You can cancel renewal at any time from Credits & billing in your dashboard; cancellation takes effect at the end of the current billing period
• Only one subscription can be active at a time, including a subscription that is scheduled to end
• One-time packs can be purchased in addition to an active subscription
• Prices are subject to change with 30 days' notice
• Payments are processed by our third-party payment processors

3.6 Legacy Subscriptions

Customers who purchased one of our former subscription plans before the introduction of credit plans keep their existing entitlements until those subscriptions end. These former plans are no longer offered to new customers.

4. Credits and Usage

4.1 Credit Costs

• AI virtual staging image: 10 credits per image
• AI scene video: 50 credits per video (5 seconds, 1080p, camera motion generated from one of your staged images)
• Credits are deducted when a task is submitted and automatically returned to your balance if the generation fails
• Images generated with credits have no watermark

4.2 Credit Expiry

• Monthly subscription credits expire at the end of each billing period
• Yearly subscription credits do not expire
• One-time pack credits are valid for one month
• Each purchase keeps its own expiry date

4.3 Listing Slideshow Videos

Listing slideshow videos are assembled from your existing staged photos without AI generation. For customers on a credit plan they do not use credits, subject to a fair-use cap of 20 slideshow videos per day.

4.4 Concurrent Tasks

On credit plans, up to 3 generation tasks can run at the same time.

4.5 Fair Use

The Service is intended for normal business usage by real estate professionals. Excessive automated requests, attempts to bypass credit charges or usage caps, or attempts to resell our service may result in throttling or account suspension.

5. Intellectual Property and Content Rights

5.1 Your Content

You retain all rights to the photos you upload. By uploading content, you grant us:

• A license to process, store, and generate staging images from your photos
• The right to use uploaded images solely to provide our Service to you
• We do not claim ownership of your original photos

5.2 Generated Content

• Paid Plans: You own all AI-generated staging images and videos created with your account
• Free Plan: Generated content includes a watermark and is for evaluation purposes only
• You may use generated content for commercial real estate marketing purposes

5.3 MLS and Listing Disclosure Requirements

You are responsible for complying with MLS and local regulations. When using virtually staged images on MLS, Zillow, or other listing platforms, you must include appropriate disclosure (e.g., "Virtually Staged" or "Photos Virtually Staged"). RoomX AI is not liable for non-compliance with disclosure requirements.

5.4 Our Platform and Technology

RoomX AI retains all rights to our platform, AI models, algorithms, and technology. You may not reverse engineer, copy, or create derivative works from our Service.

6. Prohibited Activities

You agree NOT to:

• Upload images you do not have rights to use
• Use the Service for illegal purposes or to create deceptive content
• Share your account credentials or transfer your subscription or credits
• Attempt to circumvent credit charges, usage limits, or payment systems
• Upload offensive, harmful, or inappropriate content
• Resell or redistribute our Service without authorization
• Use automated bots or scripts to abuse the Service

7. Service Availability and Limitations

7.1 Uptime and Maintenance

We strive for 99% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.

7.2 Content Quality

AI-generated results depend on input photo quality. We do not guarantee specific results and recommend reviewing all generated content before use.

7.3 Beta Features

Some features may be labeled as "Beta" or "Coming Soon" and are provided as-is without warranties.

8. Disclaimers and Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOMX AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS.

9. Indemnification

You agree to indemnify and hold harmless RoomX AI from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights (including MLS disclosure violations).

10. Termination

10.1 Cancellation by You

You may cancel automatic renewal of your subscription at any time from Credits & billing in your dashboard. Cancellation takes effect at the end of the current billing period; credits already issued keep their existing expiry dates.

10.2 Termination by Us

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or misuse the Service.

10.3 Data Deletion

Upon account termination, your data will be retained for 90 days before permanent deletion.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except for small claims court matters.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a notice on our website. Continued use after changes constitutes acceptance.
